A loan settlement company negotiates with your bank or NBFC to close an overdue unsecured loan for less than the full amount, with every term in writing. Settlement is legal in India, but it is a last resort: the account is reported as 'settled', which lenders read as a negative for years. This guide explains how it works, what it costs and how to choose a company you can trust.

What loan settlement is, and what it is not

In a settlement, the lender agrees to accept a reduced lump sum, or a few instalments, to close the loan. Banks call this a one-time settlement (OTS) or a compromise settlement. It is not a loan waiver: you still pay, the lender decides the amount, and the account is reported to credit bureaus as 'settled' rather than 'closed'.

Is loan settlement legal in India?

Yes. Banks and NBFCs settle loans under their own board-approved policies. RBI's June 2023 framework for compromise settlements requires regulated lenders to have such policies, and lets them settle even with borrowers in serious default. Two limits matter: the lender decides whether to settle (you cannot demand it), and after a compromise settlement the lender must wait at least 12 months before giving you fresh credit on non-farm loans.

Be careful with anyone who promises a 'loan waiver' for a fee. RBI has publicly warned borrowers about such campaigns: only your lender can agree to reduce what you owe, and only in writing.

Which loans can be settled?

  • Personal loans from banks and NBFCs

  • Credit card dues

  • Overdrafts and unsecured business loans

  • Loan-app and buy-now-pay-later dues from lenders regulated by RBI

Secured loans such as home, vehicle and gold loans follow different rules because the lender can sell the asset. Loan Counsel works only on unsecured debt.

How the settlement process works, step by step

  1. Assessment: list every loan, the overdue amount, your income and what you can realistically pay as a lump sum.

  2. Calm the pressure: move communication to writing and use your rights against harassment while talks happen.

  3. Hardship proof: job-loss letters, medical bills or business losses show the lender why full repayment is not possible.

  4. Proposal: a written settlement request to the lender's collections or recovery team, with an amount you can actually pay.

  5. Negotiation: lenders often counter-offer; the final figure depends on the loan's age, the lender's policy and your situation.

  6. Settlement letter: get it on the lender's letterhead before you pay, with the amount, the payment deadline, the loan account number and how the account will be reported.

  7. Payment: pay only into the lender's own account and keep every receipt. Never pay a settlement amount to an agent or a third party.

  8. Closure: collect the no-dues certificate or NOC, then check your credit report after 30 to 45 days to confirm the status.

What settlement does to your CIBIL score

A settled account stays in your credit history, and most lenders treat it as a negative when you apply again. Many borrowers later pay the waived amount to have the status changed to 'closed'; ask your lender for that in writing. Read more on how settlement affects your CIBIL score and settled vs written off.

What should a loan settlement company charge?

There is no regulated fee scale. A fair company explains its fee in writing after assessing your case, links it to the work it does, and never asks you to route the settlement payment through its own account. Be wary of large fees taken before any work starts. See how our fees work.

How to choose a loan settlement company you can trust

  • A written agreement that lists what they will and will not do

  • No guaranteed percentage: only your lender decides the final amount

  • No advice to stop paying so that you 'qualify' for a settlement

  • Settlement money always goes straight to the lender

  • A real office and named people you can meet or call

  • Help with legal notices when needed, through enrolled advocates

  • Reviews from real clients, not anonymous testimonials

When settlement is the wrong choice

  • You could manage a lower EMI if the loan were restructured

  • You plan to apply for a home loan in the next few years

  • Your lender is offering a hardship plan or an EMI holiday

  • Most of your debt is secured against your home or vehicle

In those cases, start with loan restructuring or a debt management plan.

Frequently asked questions

How long does a loan settlement take?

Usually a few weeks to a few months per lender, depending on how overdue the loan is, the lender's internal approvals and how quickly you can arrange the payment.

Can I settle a loan before it becomes an NPA?

Sometimes. Most lenders consider settlement only after a loan has been overdue for a while, usually once it becomes an NPA after 90 days. Before that, restructuring or a payment plan is more common.

How much will the bank accept?

There is no fixed percentage. The amount depends on the lender's policy, the age of the overdue, your documented hardship and whether you can pay a lump sum. Our settlement calculator gives a rough estimate, not an offer.

Will settlement stop recovery calls?

Once the agreed amount is paid and the account is closed as settled, recovery stops. While talks are going on, agents must still follow RBI's rules; see our guide to stopping recovery agent harassment.

What proof should I keep after settling?

The settlement letter, every payment receipt, the no-dues certificate or NOC, and a credit report showing the updated status. Keep them permanently.
