Recovery Agent Harassment Help: How to Stop It Legally in India (2026)
Updated: 5 days ago
Recovery agents can contact you about an overdue loan, but they cannot threaten you, abuse you or shame you in front of others. If that is happening, you can stop it legally: record everything, complain to the lender in writing, escalate to the RBI Ombudsman, and go to the police or the cyber-crime portal for threats. Here is the full process.

What recovery agents are allowed to do
Call or message you about overdue dues between 8 am and 7 pm
Visit your home or workplace in that window, carrying an identity card and the lender's authorisation letter
Tell you the amount due and the lender's legal options, factually
Discuss repayment, restructuring or settlement, and collect payments against an official receipt
What counts as harassment
RBI's rules for lenders that use recovery agents bar intimidation or harassment of any kind, verbal or physical. In practice, all of these are against the rules:
Calls before 8 am or after 7 pm, unless you asked for them
Abusive, obscene or threatening language, or threats of violence
Repeated, anonymous or excessive calls meant to wear you down
Shaming you before family, friends, referees, neighbours or colleagues
Messages or social-media posts that reveal your debt, photos or personal details
False claims, such as threats of arrest for a missed EMI or fake court papers
Demanding cash without a receipt, or payment into a personal account
New RBI recovery rules from 1 January 2027
RBI issued new recovery directions on 6 August 2026 for banks, with parallel directions for other regulated lenders, all taking effect on 1 January 2027. The main changes for borrowers:
At least one day's notice before an agent's first in-person visit, naming the agency assigned
Lenders must publish their empanelled recovery agencies and tell you if the agency changes
Agents must be certified by the Indian Institute of Banking and Finance or an approved institute
No contact during bereavement, medical emergencies or similar sensitive occasions
Every recovery communication must carry the lender's grievance officer details
Lenders must compensate borrowers for losses caused by recovery that breaks the rules, as set out in their policy
Until then the existing rules apply, and harassment was never allowed. Read the full breakdown of the 2027 recovery rules.
How to stop recovery agent harassment, step by step
Record every incident: date, time, number, the agent's name and exactly what was said. Save screenshots, messages and call logs.
Ask for the agent's identity card, agency name and authorisation letter. Pay only into the lender's official account and always get a receipt.
Complain in writing to the lender's grievance redressal officer or nodal officer, attach your evidence, and ask that all contact be in writing. Keep the acknowledgement.
If the lender rejects your complaint or does not reply within 30 days, complain free of charge to the RBI Ombudsman at cms.rbi.org.in (RBI contact centre: 14448).
For threats, abuse or intimidation, file a police complaint. Criminal intimidation (section 351), defamation (section 356) and insulting a woman's modesty (section 79) are offences under the Bharatiya Nyaya Sanhita.
For online threats, morphed photos or messages to your contacts, report at cybercrime.gov.in or call 1930.
If the lender or app is not regulated by RBI, report it on RBI's Sachet portal at sachet.rbi.org.in.
Then deal with the overdue loan itself, because harassment stops for good only when the debt is resolved. Our guide to your options after a missed EMI shows where to start.
Loan app harassment: contacts, photos and threats
Apps must lend through an RBI-regulated bank or NBFC, and their agents follow the same rules. Check whether an app is linked to a regulated lender in RBI's directory of digital lending apps, remove contact and gallery permissions from your phone, and do not pay extra amounts that were never in your loan agreement. Our guides on loan app harassment and spotting fake loan apps walk through it.
What not to do
Do not ignore legal or arbitration notices; reply in time or get help
Do not argue or abuse back on calls; it weakens your complaint
Do not hand cash to an agent or sign blank papers
Do not take a new app loan to pay off an old one

Frequently asked questions
Can a recovery agent come to my house?
Yes, between 8 am and 7 pm, with an identity card and the lender's authorisation letter. From 1 January 2027 lenders must also give you at least one day's notice before the first visit. Agents cannot threaten you, enter without permission or create a scene. More in can recovery agents visit your home.
Can recovery agents call my family or office?
They cannot use your family, friends, referees or colleagues to shame or pressure you. RBI's rules specifically bar acts that humiliate you publicly or intrude on the privacy of the people around you.
Can I be arrested for not paying a loan?
Not for a missed EMI alone: loan default is a civil matter. Criminal cases arise only in specific situations, such as a bounced cheque under section 138 of the Negotiable Instruments Act, a bounced auto-debit under section 25 of the Payment and Settlement Systems Act, or fraud. An agent who threatens arrest for a missed EMI is misleading you. See what to do after an EMI bounce notice.
Do these rules apply to NBFCs and loan apps?
Yes. The current rules apply to regulated lenders including NBFCs, and RBI issued parallel 2027 directions for the different types of lenders. Apps that lend through a regulated bank or NBFC are covered through that lender.
Will the harassment stop if I settle the loan?
Yes, once the agreed amount is paid and the lender confirms closure in writing. While talks are going on, you can still use every step above. See how loan settlement works in India.
