Payday Loan Settlement in India: How to Get Out of the Short-Term Loan Trap
Updated: 5 days ago
"Instant cash till your salary comes." That is how most payday-style loans are sold in India. They are small, short-term loans, often for a few days or weeks, usually taken through a mobile app. The trouble starts when the repayment date arrives before you have the money, so you borrow from a second app to repay the first, and then a third.
If this sounds familiar, you can get out of it. This guide explains how payday loan settlement works in India, what the RBI rules say, and how to break the cycle without making things worse.
Key takeaways
India has no separate "payday loan" law. These are digital loans, and only RBI-regulated lenders can lend. Their apps must follow RBI's digital lending rules.
Check whether the lender is genuine. Loans from unregulated apps should be reported, not just repaid.
Stop borrowing from new apps to repay old ones. List every loan and its real cost first.
Settlement of short-term loans is possible but depends on the lender. It is reported as "settled" and affects your CIBIL score.
Lenders and their apps must not access your contact list or photos, or harass your contacts.

How the payday loan cycle starts
A typical story: you borrow a small amount for 7 to 30 days. Processing fees and interest are deducted or added, so the real annual cost can be very high. On the due date you are short, so you take a loan from another app. Within a few months, you may owe several apps, each with late fees.
The first job is to stop the cycle. Write down every loan: app name, the lender behind it (the bank or NBFC named in the loan agreement), amount borrowed, amount demanded now, due date, and days overdue.
What RBI's digital lending rules say
RBI first issued digital lending guidelines in September 2022 and consolidated them in the Digital Lending Directions, 2025. Key protections for borrowers include:
Loans only from regulated entities. The money must come from, and be repaid directly to, the bank account of an RBI-regulated lender, not a third party's pool account.
A Key Fact Statement (KFS) before you sign, showing the Annual Percentage Rate (APR), which includes fees and charges.
A cooling-off period in which you can exit the loan by repaying the principal and proportionate interest without a penalty. Under the 2022 guidelines, this is at least three days for loans of seven days or more, and one day for shorter loans.
Data limits. Apps must not access your phone's files and media, contact list or call logs.
Grievance redress. If your complaint is not resolved within 30 days, you can escalate it to the RBI Ombudsman through cms.rbi.org.in.
RBI also publishes a directory of digital lending apps reported by regulated lenders on its website, which you can use to check whether an app is linked to a genuine lender. Our guide on how to check if a loan app is genuine walks through this.
Step-by-step: settling payday and app loans
Step 1: Sort genuine lenders from illegal apps
If the app is linked to an RBI-regulated bank or NBFC, you are dealing with a real debt that needs a plan. If it is not, and especially if it harasses you or threatens to share your photos, report it on the National Cyber Crime Reporting Portal (cybercrime.gov.in) or call the cyber helpline 1930. You can also report unauthorized lending on RBI's Sachet portal.
Step 2: Prioritize
Pay the smallest, most expensive genuine loans first if you can, and contact the rest. Do not take new loans to cover old ones.
Step 3: Write to each lender
Email the lender's grievance officer (details should be in the app and KFS). Explain your situation and propose either a short instalment plan or, if you cannot repay in full, a one-time settlement. Ask for any late fees to be waived.
Step 4: Get it in writing
Any settlement must be confirmed in writing by the lender, stating the amount, the deadline and that the loan will be closed after payment. Pay only through the lender's official repayment channel.
Step 5: Keep proof and check your credit report
Save the settlement letter and payment receipt. After a few weeks, check your credit report to confirm the account status was updated.
The impact on your CIBIL score
Genuine lenders report to credit bureaus. A settled loan is reported as "settled", which affects your CIBIL score and can make borrowing harder for some time. Since payday loans are small, it is often worth trying to pay them in full through a short instalment plan instead of settling, if you can manage it.
Dealing with harassment
Abusive calls, messages to your contacts or threats to post your photos are not legal recovery methods. Under RBI rules, recovery agents may call only between 8 am and 7 pm and must not threaten or shame you. Save screenshots and call records and complain to the lender, then the RBI Ombudsman, and to cyber police for threats or misuse of your data. Our step-by-step guide on stopping loan app harassment legally has more detail.

Frequently asked questions
Can I settle a payday loan for less than I owe?
Some lenders agree to settle, especially after a long default, but it is entirely their decision and there is no fixed discount. The account will show as "settled" on your credit report.
Do I have to repay a loan from an illegal app?
Report illegal apps to cyber police and RBI's Sachet portal first, and get advice on your specific case before paying anything further.
Can a payday lender take legal action against me?
A regulated lender can take legal steps to recover dues. If you gave an auto-debit mandate or a cheque that bounced, that can also lead to legal proceedings. Respond to any notice and get advice.
How do I stop needing payday loans again?
Build a small emergency fund, even Rs 500 a month, uninstall lending apps you no longer use, and plan expenses around your salary date.
