Loan Settlement in Chennai: Your Options, Rights and Next Steps
Updated: 5d
Chennai is home to salaried professionals, small business owners and gig workers who rely on personal loans, credit cards and app-based credit. When income drops or expenses spike, EMIs can quickly fall behind, and recovery calls start soon after.
If you are in Chennai and struggling with loan repayments, this guide explains your options, the rules that protect you in Tamil Nadu, and how loan settlement works, so you can take the next step calmly.
Key takeaways
Talk to your lender early. Restructuring, tenure extension or an EMI plan is easier to get before your account becomes a non-performing asset.
Tamil Nadu's Money Lending Entities (Prevention of Coercive Actions) Act, 2025 prohibits coercive recovery such as intimidation and repeated visits to harass borrowers. Its coercion provisions cover money lending entities, including NBFCs operating in the state, but not banks.
RBI rules apply across India: recovery agents may contact you only between 8 am and 7 pm and must not threaten or abuse you.
Settlement is at the lender's discretion and is reported as "settled", which affects your CIBIL score.
Always get a written settlement letter before paying anything.

Common loan problems Chennai borrowers face
The situations we hear about most often include:
Personal loan EMIs that became unaffordable after a job loss or salary cut
Several credit cards with balances growing every month
Small loans from apps that were rolled over again and again
Business loans affected by a slow season or delayed payments from clients
Recovery calls to family members, colleagues or neighbours
Each situation needs a different approach, but the first step is the same: list every debt, how much is overdue, and what you can realistically pay each month.
Your rights during recovery in Tamil Nadu
The Tamil Nadu anti-coercion law
In June 2025, Tamil Nadu notified the Tamil Nadu Money Lending Entities (Prevention of Coercive Actions) Act, 2025. Among other things, it prohibits lenders and their agents from intimidating or insulting borrowers or their family members, persistently following them, frequenting their home or workplace to coerce payment, and forcibly taking documents or household items. Violations can attract imprisonment and fines. Legal commentators note that the coercive-recovery sections apply to NBFCs functioning in Tamil Nadu but not to banks.
RBI's recovery rules
Whatever the lender, RBI rules on recovery agents apply nationwide. Agents should contact you only between 8 am and 7 pm, carry authorisation, and must not use threats, abuse or public shaming. RBI has notified updated recovery conduct rules applying from 1 January 2027.
If you face harassment, record the date, time, number and what was said. Complain in writing to the lender's grievance officer. If there is no reply within 30 days, or the reply is unsatisfactory, you can file a free complaint with the RBI Ombudsman at cms.rbi.org.in. Threats of violence should be reported to the police.
Your options for repaying or settling
Restructuring or tenure extension
If your income is reduced but not gone, ask the lender to extend the tenure or restructure the loan to lower the EMI. This keeps your account alive and is usually better for your credit record than settlement.
Converting card dues to EMIs
Most card issuers offer EMI conversion on outstanding balances. Ask for the interest rate and fees in writing before agreeing.
One-time settlement
If you genuinely cannot repay in full, a one-time settlement may be possible. The lender decides whether to accept and at what amount; there is no fixed percentage. Settlement is reported to credit bureaus as "settled", which affects your CIBIL score and future borrowing. Get the offer on the lender's letterhead and pay only into the lender's official account.
Legal notices and courts
If your lender sends a legal notice, read it carefully and respond within the time stated. For larger claims, banks and financial institutions can approach the Debts Recovery Tribunal (DRT); the threshold for DRT cases is a debt of Rs 20 lakh and above, and Chennai has its own DRT benches. Smaller claims usually go through civil courts, arbitration (if your loan agreement has an arbitration clause) or Lok Adalats, which offer a voluntary forum to settle disputes.
Getting advice before you respond can help you avoid admissions or commitments you cannot keep.
Choosing help in Chennai
Many firms offer loan settlement services. Before paying anyone, check that they explain fees in writing, do not ask you to pay settlement money into their own account, and do not promise guaranteed discounts. Our checklist of red flags in loan settlement companies can help you decide.

Frequently asked questions
Can I settle a loan in Chennai without visiting the lender's branch?
Often, yes. Much of the communication can happen over email, phone and official portals. However, you may be asked to sign documents or visit a branch to complete the settlement.
Does the Tamil Nadu anti-coercion law cancel my loan?
No. It protects you from coercive recovery methods, but the debt still exists and you still need a plan to repay or settle it.
How long does a loan settlement take?
It depends on the lender, how long the account has been overdue and how quickly you can arrange funds. There is no fixed timeline.
Will settlement remove the default from my credit report?
No. The account shows as "settled", and earlier missed payments remain in your history. It affects your CIBIL score for some time.
